Terms and Conditions

Your use of the State Resource Information Management System(SRIMS) constitutes your agreement to be bound by these Terms and Conditions in relation to your use of and the performance of the SRIMS and the content, information and software contained in or provided by it.

1. Access and Use

  1. As a user of the SRIMS you are granted a non-exclusive, non-transferable, revocable, limited licence to access the SRIMS and all content, information and software provided by or through the SRIMS in accordance with:
    1. these Terms and Conditions (which incorporate the terms and conditions under “Disclaimer”, “Copyright” and “Privacy” links on the logon page); and
    2. additional terms that govern your use of or access to specific parts or sections of this website in which case those specific terms will apply to your activities at those locations in addition to these terms.
  2. These Terms and Conditions replace any other terms of use for the SRIMS published on the SRIMS to date. We may at any time and for any reason vary these Terms and Conditions by publishing variations. By using the SRIMS after the Terms and Conditions have been varied, you agree to be bound by the varied Terms and Conditions.
  3. You agree:
    1. that by uploading content to or submitting any materials for use on the SRIMS you grant to us a perpetual, worldwide, royalty-free, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, create derivative works from and distribute materials or incorporate such materials into any form, medium or technology;
    2. that you will not provide your SRIMS User ID and Password to another person;
    3. to take all necessary steps to protect your SRIMS User ID and Password from unauthorised access, use or disclosure by any person;
    4. to immediately contact DTF on becoming aware of any unauthorised access to, use or disclosure of your SRIMS User ID or Password by any person;
    5. to immediately contact DTF of any change in the e-mail address associated with your SRIMS User ID;
    6. to immediately advise DTF of any change to your role that that should change your SRIMS security profile; and
    7. to comply with any directions relating to the SRIMS which are given by DTF from time to time.
  4. Any notices relating to SRIMS access and downtime issues may be sent to the e-mail address associated with your User ID for notification.

2. Withdrawal and Suspension of Access to SRIMS

We may wholly withdraw, or suspend for a period of time, the SRIMS, or your licence to access the SRIMS for any reason including, without limitation, where there is an interruption, fault, virus, or unauthorised access or where maintenance or upgrading of the SRIMS is required.

SRIMS accounts will be end-dated and de-activated. Inactive accounts will be suspended if you have not logged on during a 12 month window. To regain access to SRIMS you will have to complete a new user registration form and submit this to the SRIMS Helpdesk after obtaining the appropriate authorisation.

3. Confidentiality

  1. You acknowledge that information published, or accessible, through the SRIMS may contain confidential and commercially sensitive information and information with a security classification.
  2. You may only use and disclose the confidential information within your organisation and for internal business purposes. You may not otherwise make public, disclose to any person or use any of the confidential information.
  3. You are not obliged to keep confidential any information that is required to be disclosed as a result of any legal obligation (including disclosure under the Freedom of Information Act), or a government policy of the State of Victoria or by order of the State of Victoria acting through any government agency.
  4. You agree to immediately notify us if you become aware of any breach of this clause.

4. Personal Information

  1. You acknowledge that except for Personal Information required for the purposes of registration, you are not required to provide any Personal Information in order to use this SRIMS.
  2. You acknowledge that some information that you voluntarily provide in using this website, may constitute Personal Information relating to you or to another person.
  3. You consent to us collecting, using and/or disclosing your Personal Information for the Approved Purposes in accordance with our Privacy Statement. If the Personal Information provided is that of another individual, you represent by providing that information that you have obtained the consent of the individual for the Approved Purposes.

5. Links from this website

  1. SRIMS may include links to websites operated by other government bodies and non-government organisations.
  2. These linked sites will have their own terms and conditions of use and you should familiarise yourself with these.
  3. Although every care is taken to provide links from the SRIMS to suitable material, we do not make any warranty or representation about the suitability, quality and accuracy of any of the material that the SRIMS may be linked to nor do we accept any responsibility or liability for any loss or damage which you may suffer as a result of accessing or using any material which may appear at a linked site.
  4. Links to websites are provided for your assistance but do not constitute an endorsement or sponsorship by us of the practices, views or information contained at any linked site. In the same manner, the absence of a link from SRIMS to any website should not be treated as an absence of endorsement or support for the operator or content of that website.

6. Termination of Use

If, in our reasonable opinion, you breach these Terms and Conditions, we may suspend, terminate or limit your licence to access the SRIMS. If we do not act in relation to a breach by you of these Terms and Conditions, this does not waive our right to act with respect to subsequent or similar breaches.

7. Governing Law

The Terms and Conditions are governed by and are to be construed according to the laws applicable to the State of Victoria. You submit to the exclusive jurisdiction of the courts of Victoria.

8. Definitions

In these Terms and Conditions of Use:

  1. Approved Purposes means:
    1. Verification, authorisation and security of user access;
    2. Provision of information that may be relevant to the areas of interest identified by you;
    3. Collection, using, holding, publishing and communicating the information (or an adaptation of this information) in SRIMS, and for DTF reporting and communication purposes;
    4. Disclosure as a result of any legal obligation (including disclosure under the Freedom of Information Act), or a government policy of the State of Victoria or by order of the State or Victoria acting through any government agency; and
    5. Disclosure to the State’s contractors, sub-contractors and service providers but only for the purposes described in (a)(i)-(iv) above;
    6. Approved Purposes will not include providing your personal information to unrelated third parties for marketing or advertising purposes.
  2. Terms and Conditions means these Terms and Conditions of Use.
  3. User ID means a name or acronym used by you for the purpose of accessing the secure parts of this website.
  4. We, our or us means the State of Victoria represented by the Department of Treasury and Finance.
  5. You or your means the person who accepts these Terms and Conditions by using the SRIMS.
